LIABILITY WAIVER AGREEMENT

  • I understand that Training may involve risks to myself, members of my family, third parties or my dog. I hereby accept and assume, without reservation, all risks associated with my participation in Training including, but not limited to, the risks of any and all injuries to myself, my dog, my family members or third parties who may participate in training.


  • I understand that there is always some unavoidable risk involved when working with dogs, and in the unlikely event, that may cause injury or death. I believe that every effort will be made to ensure the safety of me and my dog, however in the unlikely event me and/or my dog(s) is injured, whether by another dog(s) or another cause, I assume all risks associated with participating in this Training. I AGREE TO FULLY INDEMNIFY, RELEASE AND HOLD HARMLESS KINDRED SPIRIT RANCH, LLC AND ITS OWNERS, CONSULTANTS, TRAINERS, PRINCIPALS, AGENTS, REPRESENTATIVES, AND THE PROPERTY OWNER WHERE TRAINING IS HELD, FROM ANY AND ALL LIABILITY AND CLAIMS OF ANY NATURE INCLUDING BUT WITHOUT LIMITATION ALL COSTS, LOSSES AND LEGAL EXPENSES INCURRED OR ANY OTHER CLAIMS, INCLUDING ORDINARY NEGLIGENCE, IN THE EVENT OF INJURY TO MYSELF, FAMILY MEMBERS, THIRD PARTIES OR MY DOG(S). 


  • I agree to assume all responsibility for any damage done to property, persons, or other dogs done by me or my dog’s actions. I understand that if my dog(s) is the cause of property damage, I shall solely be legally and financially responsible for all costs related to the damage. I understand that if my dog(s) is the cause of injury or death to another animal or person, I shall solely be legally and financially responsible for all costs related to the injury, death or damage to the other dog and/or person as well as my-own dog. I AGREE TO FULLY INDEMNIFY, RELEASE AND HOLD HARMLESS KINDRED SPIRIT RANCH, LLC AND ITS OWNERS, CONSULTANTS, TRAINERS, PRINCIPALS, AGENTS, REPRESENTATIVES, AND THE PROPERTY OWNER WHERE TRAINING IS HELD FROM ANY AND ALL LIABILITY AND CLAIMS OF ANY NATURE INCLUDING BUT WITHOUT LIMITATION ALL COSTS, LOSSES AND LEGAL EXPENSES INCURRED OR ANY OTHER CLAIMS, INCLUDING ORDINARY NEGLIGENCE, BROUGHT BY MYSELF OR A THIRD PARTY ARISING FROM OR RELATED TO THE ACTIONS OF ME AND/ OR MY DOG(S). 


  • I understand that all dogs participating in the Training must be free of all infectious diseases and must be current on all appropriate vaccinations, I understand that it is still possible for a dog to become ill, even if vaccinated. I UNDERSTAND THIS RISK AND AGREE THAT KINDRED SPIRIT RANCH, LLC OR ITS OWNERS, CONSULTANTS AND TRAINERS ARE NOT LIABLE FOR ANY ILLNESS SUFFERED BY YOUR DOG(S) DURING OR AFTER TRAINING. 


  • I agree that Kindred Spirit Ranch, LLC and its Owners, Consultants and Trainers reserves the right to determine if me and my dog are suitable for Training and reserves the right to refuse to accept us for Training at their discretion for any reason including but not limited to sick or injured dog(s), inappropriate behavior for the environment and incomplete vaccination records. 


  • If a dog(s) in my care for whom I am not the owner, participates in dog training, I agree to assume all financial and legal responsibilities associated with participation in dog training and all terms and conditions in this Dog Training Waiver and Release shall apply without exception to myself and such dog(s)in my care.


  • I represent that I am the owner of the dog(s) and fully authorized to enter into this Dog Training Waiver and Release, have had the opportunity to discuss it to my satisfaction and agree to its terms.  


I fully understand that the Trainer has not represented, promised, guaranteed, or warranted that said dog can be trained, that said dog will not be dangerous or vicious in the future, that said dog will not exhibit other behavioral problems, or that the training will last for any particular amount of time.*
Owner agrees to pay all costs when taking puppies to the vet for puppy shots and worming. KSR will send the owner receipts from the vet and you will pay KSR back.*
Owner understands that KSR keeps a very close eye on all puppies for any illness and worms. If KSR feels in any way that the puppy needs to go to the vet prior to its vaccination schedule, Owner agrees to pay the total receipt for the puppy’s visit. *
Owner understands that Kindred Spirit Ranch does everything it can to protect each puppy from disease and any harm.*
Owner understands that Kindred Spirit Ranch trains other dogs outside of the Puppy Boot Camp. When KSR brings other dogs in, they are vaccinated fully and checked. *
Kindred Spirit Ranch reserves the right to immediately change your pet’s type of boarding if we believe it is necessary to protect the health and well-being of your pet, other pets, or our staff, and Owner agrees to pay any additional costs associated with the change.*
Owner agrees to pay all costs and charges for special services requested and provide updated vaccination records from your vet before starting boarding or board training.*
Owner agrees that the pet shall not leave the kennel until all charges are paid in full to Kindred Spirit Ranch.*
Owner agrees to be solely responsible for any and all acts or behavior of Owner’s pet while it is in the care of Kindred Spirit Ranch.*
Owner specifically represents that they are the lawful and valid owner of the pet, free and clear of all liens and encumbrances.*
Owner specifically represents that the pet has not been exposed to rabies or distemper within 30 days prior to boarding.*
Owner agrees that in the event the boarding charges are not paid when due in accordance with this agreement, Kindred Spirit Ranch may exercise its lawful rights upon ten (10) days written notice by delivering such notice via first-class mail to Owner’s Address. A pet that is unclaimed at KSR for ten (10) days beyond its scheduled discharge date is considered abandoned and will become the property of KSR. Every effort will be made to contact Owner if abandonment becomes an issue. If for any reason the pet is not going to be picked up on the scheduled dismissal date, Owner shall contact KSR to make arrangements to extend the animal's stay and will pay the additional charges based upon the aforesaid daily rate Kindred Spirit Ranch at its sole discretion. *
KSR is authorized to engage the services of a veterinarian or arrange for other requisite attention to the animal up to and including $500.00 or an amount below that is higher. If a veterinarian determines that emergency treatment, which Exceeds the authorized amount, is needed to save the animal’s life or quality of life, and we cannot reach you or the Emergency Contact, we may authorize the veterinarian to perform the emergency treatment. Owner agrees to be responsible for all veterinary costs provided to your animal.*
It is expressly agreed by Owner and Kindred Spirit Ranch that KSR liability in no event exceeds the lesser of the current chattel value of a pet of the same species or the sum of $200.00, whichever is less.*
Owner agrees to release, indemnify, and hold harmless Kindred Spirit Ranch from any and all manner of damages, claims, loss, liabilities, costs or expenses, including reasonable attorney’s fees and related costs, arising out of or related to KSRs’ services, except which may arise from the gross negligence or intentional and willful misconduct of KSR, including, without limitation, (i) any inaccuracy in any statement made by yourself or information provided by you to KSR (ii) your dog, including but not limited to destruction of property, dog bites, injury, and transmission of disease, and (iii) any action by yourself which is in breach of the terms and conditions of this agreement.*
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Each party consents to the exclusive personal jurisdiction of the state and federal courts of the State of Texas. Owner and Kindred Spirit Ranch must negotiate and mediate in good faith prior to either party filing a cause of action.*
Force Majeure. Neither Owner nor Kindred Spirit Ranch shall be responsible for failure or delay in performing its duties under this Agreement if such failure or delay is due to tornados, thunderstorms, fire, floods, drought, riot, war or other acts of nature.*
Words “you” and “your” refers to the Owner. Conversely, “We” and “our” refers to Kindred Spirit Ranch. Owner and KSR may collectively be referred to as “the parties”, and singularly as a “party”.*
Entire Agreement. This agreement, and any addendums attached, constitutes the entire agreement between the parties. All terms and conditions of this agreement shall be binding on the heirs, agents and assigns of Owner and Kindred Spirit Ranch.*
